1. Overview

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Patient," "you," or "your") and PeakLAB Medicine, operated by Dr. Lindsey Bailey, DO ("PeakLAB," "we," "our," or "us"). By enrolling in a PeakLAB Medicine membership, booking a consultation, or using our website at peaklabmed.com, you agree to be bound by these Terms.

Please read these Terms carefully before enrolling. If you do not agree with any part of these Terms, you should not enroll in a membership or book services with PeakLAB Medicine.

Key summary: PeakLAB Medicine memberships require a 3-month minimum commitment. After the initial 3-month period, monthly memberships may be cancelled with 30 days' written notice. Annual memberships are non-refundable. These Terms govern all aspects of your relationship with PeakLAB Medicine.

2. Eligibility

To enroll in PeakLAB Medicine services, you must:

  • Be at least 18 years of age.
  • Be a resident of a state in which Dr. Bailey is licensed to practice medicine (currently Colorado, Arizona, and Nebraska). Licensure may change; it is your responsibility to confirm current licensure at the time of enrollment.
  • Have the legal capacity to enter into a binding agreement.
  • Not be enrolling for the purpose of obtaining controlled substances or prescriptions that are not clinically indicated.

PeakLAB Medicine reserves the right to decline enrollment or terminate a membership at its sole discretion, including if it determines that the clinical relationship is not appropriate or safe.

3. Scope of Services

PeakLAB Medicine provides integrative and functional medicine services via telemedicine, including but not limited to: hormone optimization, metabolic health and weight management, longevity medicine, and sports performance medicine. All services are provided by Dr. Lindsey Bailey, DO, a licensed physician.

What is included in a membership: Memberships include the scheduled consultation visits described in your selected tier, access to the secure patient messaging portal, personalized care planning, lab ordering and review, and the discounts on supplements and specialty testing described on our Memberships page.

What is not included: Membership fees do not include laboratory fees (billed directly by LabCorp or Quest), specialty testing fees (e.g., DUTCH hormone panel), medication costs (including GLP-1 medications filled through a compounding pharmacy), or any services not explicitly described in your membership tier.

PeakLAB Medicine is a direct-pay practice and does not bill insurance. We provide superbills upon request so you may seek out-of-network reimbursement from your insurer, but we make no guarantee that any services will be reimbursed.

4. Membership Terms

PeakLAB Medicine offers three membership tiers — Summit, Peak, and Pinnacle — each with distinct visit allowances, access levels, and pricing. Full details are available on our Memberships page.

3-Month Minimum Commitment

All PeakLAB Medicine memberships — monthly and annual — require a minimum commitment of three (3) consecutive months from the date of enrollment. This minimum exists because meaningful integrative medicine outcomes require time: an initial consultation, laboratory testing, protocol development, and at least one follow-up review are necessary before the clinical relationship can be properly evaluated. Cancellation requests submitted before the completion of the 3-month minimum period will not be honored, and charges for the remaining months of the minimum term will apply.

Monthly Memberships

Monthly memberships are billed on a recurring monthly basis from your enrollment date. After the 3-month minimum period has been completed, monthly memberships may be cancelled with 30 days' written notice (see Section 5).

Annual Memberships

Annual memberships are billed as a single payment at enrollment and represent a commitment for the full 12-month term. Annual memberships are non-refundable. However, annual memberships may be paused for up to 90 days for documented medical or personal hardship reasons, at PeakLAB Medicine's discretion. Paused months will be added to the end of the membership term.

Membership Renewal

Monthly memberships renew automatically each month unless cancelled in accordance with Section 5. Annual memberships do not auto-renew; you will be contacted prior to expiration with renewal options.

Membership Tier Changes

You may request to upgrade or downgrade your membership tier at any time by contacting us at [email protected]. Upgrades take effect at the next billing cycle. Downgrades take effect at the next billing cycle after the 3-month minimum has been satisfied.

5. Cancellation Policy

3-month minimum applies to all memberships. Cancellations are not accepted during the initial 3-month commitment period. After 3 months, monthly memberships require 30 days' written notice to cancel.

How to Cancel

To cancel your membership, you must submit a written cancellation request by email to [email protected] with the subject line "Membership Cancellation Request." Cancellations submitted by phone, voicemail, or through the patient portal messaging system will not be accepted. Your cancellation request must include your full name and the date you are requesting cancellation to take effect.

Notice Period

Monthly memberships require 30 days' written notice prior to the desired cancellation date. You will be billed for the 30-day notice period. For example, if you submit a cancellation request on April 1, your membership will remain active and you will be charged through May 1, at which point your membership will terminate.

Effect of Cancellation

Upon cancellation, you will retain access to the patient portal and secure messaging through the end of your paid period. After that date, portal access and messaging will be deactivated. Any unused visits within your membership tier do not carry over and are forfeited upon cancellation.

Termination by PeakLAB Medicine

PeakLAB Medicine reserves the right to terminate a membership immediately, without refund, in cases of: (a) abusive, threatening, or inappropriate behavior toward staff; (b) fraudulent activity; (c) violation of these Terms; or (d) a determination by Dr. Bailey that the clinical relationship is no longer appropriate or safe. In the event of termination for clinical reasons, PeakLAB Medicine will provide a 30-day transition period and assist with referrals to appropriate providers.

6. Refund Policy

Monthly memberships: Monthly membership fees are non-refundable once a billing cycle has begun. If you cancel in accordance with Section 5, you will not be charged for future billing cycles after your 30-day notice period expires, but no refund will be issued for the current or any prior billing cycle.

Annual memberships: Annual membership fees are non-refundable. No partial refunds will be issued for unused months of an annual membership.

À la carte consultations: Initial consultation fees ($475) are non-refundable once the appointment has been completed. If you cancel or reschedule your appointment with less than 24 hours' notice, a $75 late cancellation fee may apply. If you join a membership within 30 days of your initial à la carte consultation, the consultation fee will be credited toward your first month's membership fee.

Exceptions: In the event of a documented medical emergency that prevents you from using your membership, PeakLAB Medicine may, at its sole discretion, issue a partial credit or pause your membership. Requests must be submitted in writing within 14 days of the triggering event.

7. Payment Terms

All membership fees are charged to the payment method on file at enrollment. By enrolling, you authorize PeakLAB Medicine to charge your payment method on a recurring basis (monthly or annually, depending on your selected billing cycle) until your membership is cancelled in accordance with these Terms.

We accept major credit cards, debit cards, and HSA/FSA cards. All prices are in U.S. dollars. PeakLAB Medicine does not accept insurance payments directly.

If a payment fails, we will attempt to collect payment up to three times over a 7-day period. If payment cannot be collected, your membership may be suspended until payment is received. Suspended memberships do not accrue visit credits. If payment remains outstanding for more than 30 days, PeakLAB Medicine reserves the right to terminate your membership and refer the outstanding balance to collections.

Prices are subject to change. You will be given at least 30 days' written notice of any price increase before it takes effect. Continued use of your membership after the effective date of a price change constitutes acceptance of the new pricing.

8. Telemedicine Limitations

PeakLAB Medicine provides all clinical services via telemedicine (Zoom video or telephone). By enrolling, you acknowledge and accept the following limitations inherent to telemedicine care:

  • Dr. Bailey cannot perform physical examinations. Certain diagnoses and treatment decisions that would benefit from in-person evaluation may not be possible via telemedicine.
  • PeakLAB Medicine is not an emergency service. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.
  • Telemedicine services are subject to the laws and regulations of the state in which you are physically located at the time of the visit. It is your responsibility to confirm that Dr. Bailey is licensed in your state before scheduling.
  • Technical failures (internet outages, platform issues) may occasionally interrupt scheduled visits. PeakLAB Medicine will make reasonable efforts to reschedule affected appointments promptly.

9. Not a Substitute for Insurance

PeakLAB Medicine is a direct-pay concierge medicine practice. Membership fees are not health insurance premiums, and a PeakLAB Medicine membership is not a substitute for health insurance. We strongly encourage all patients to maintain adequate health insurance coverage for hospitalizations, specialist referrals, emergency care, and other services outside the scope of PeakLAB Medicine's telemedicine practice.

We provide superbills upon request, which you may submit to your insurance company for potential out-of-network reimbursement. We make no representation or guarantee that any services will be reimbursed by your insurer.

10. Patient Conduct

You agree to interact with Dr. Bailey and all PeakLAB Medicine staff in a respectful and professional manner. PeakLAB Medicine has a zero-tolerance policy for abusive, threatening, harassing, or discriminatory behavior. Violations of this policy may result in immediate termination of your membership without refund.

You agree to provide accurate and complete health information to the best of your ability. Providing false or misleading health information may compromise your care and may result in termination of your membership.

11. Limitation of Liability

To the fullest extent permitted by applicable law, PeakLAB Medicine and Dr. Lindsey Bailey, DO shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to damages for loss of health outcomes, lost profits, or data loss.

PeakLAB Medicine's total liability for any claim arising out of or related to these Terms or your membership shall not exceed the total membership fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

12. Dispute Resolution

In the event of a dispute arising out of or relating to these Terms or your membership, you agree to first contact PeakLAB Medicine in writing at [email protected] to attempt to resolve the dispute informally. We will make good-faith efforts to resolve any dispute within 30 days of receiving written notice.

If the dispute cannot be resolved informally, both parties agree to submit to binding arbitration in the State of Colorado under the rules of the American Arbitration Association. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. Each party shall bear its own costs and attorneys' fees unless the arbitrator determines otherwise.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Larimer County, Colorado.

14. Changes to These Terms

PeakLAB Medicine reserves the right to modify these Terms at any time. We will provide at least 30 days' written notice of material changes by email to the address on file with your account. Your continued use of PeakLAB Medicine services after the effective date of any changes constitutes your acceptance of the revised Terms.
